These Terms of Use ("Terms") govern your access to and use of the Big Horn Ranch website (the "Site"). By accessing or using this Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Who We Are

This Site is operated on behalf of Big Horn Ranch (the "Association," "we," "us," or "our"). The Site is intended primarily for property owners, shareholders, residents, guests, and other individuals interested in Big Horn Ranch.

2. Eligibility

By using the Site, you represent that you are at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into these Terms.

3. Your Account

Certain areas of the Site may require you to create an account or log in. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us promptly of any unauthorized use of your account or any other breach of security.

For security and fraud-prevention purposes, we may record and log access and activity related to member accounts, including IP addresses, browser information, and timestamps.

Information on this Site is provided for general informational purposes related to Big Horn Ranch and the Association's activities. While we strive to keep information accurate and up-to-date, we do not guarantee that all information is complete, current, or free from errors.

Any descriptions of community rules, bylaws, dues, or procedures on the Site may be summaries only. The official governing documents of the Association will control in the event of any conflict.

The Site and its contents, including text, graphics, logos, photos, and design, are owned by or licensed to the Association and are protected by applicable intellectual property laws. You may view and print content for your personal, non-commercial use related to Big Horn Ranch. Any other use, including reproduction, modification, distribution, or republication, without our prior written consent is prohibited.

The Site may contain links to third-party websites or services that are not owned or controlled by the Association. We are not responsible for the content, privacy policies, or practices of any third-party websites. Accessing such websites is at your own risk.

8. Payments, Dues, and Fees

The Site may allow you to pay annual dues, workday fees, fines, and other assessments by credit or debit card. By submitting a payment, you authorize the charge of the total amount shown at the time of payment, which may include an itemized payment processing fee. Amounts, due dates, late fees, and workday requirements are established by the Association's governing documents and Board, and those documents control in the event of any conflict with information shown on the Site.

Submitting a payment through the Site does not by itself waive, reduce, satisfy in part, or otherwise alter any obligation owed to the Association. You are responsible for ensuring that the share, member, and payment information you enter is accurate.

9. Refunds

Dues, workday fees, fines, and other assessments are generally non-refundable, except where a refund is required by law or is expressly approved by the Board. If you believe a charge was made in error or have a question about a payment, please contact the Association before disputing the charge with your card issuer, so the matter can be reviewed and resolved directly.

10. Payment Processing

Card payments made through the Site are handled by a third-party payment processor. Card details are submitted directly to that processor; the Association does not receive or store full card numbers on its own systems. Your use of the payment feature may also be subject to the processor's own terms and privacy policy. The Association is not responsible for the acts, omissions, or availability of third-party payment processors.

11. Ranch Activities and Assumption of Risk

Big Horn Ranch and Association activities, including workdays, may involve inherent risks. Participation in any ranch activity is voluntary and undertaken at your own risk. Nothing on the Site constitutes a representation that any activity, area, or facility is free from hazards. This Section concerns general use of the Site and does not replace or limit any separate waiver, release, or agreement the Association may require.

12. No Warranties

The Site and all content are provided "as is" and "as available," without any warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

13. Limitation of Liability

To the maximum extent permitted by law, the Association and its officers, directors, volunteers, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or relating to your use of (or inability to use) the Site, even if advised of the possibility of such damages.

14. Indemnification

You agree to indemnify, defend, and hold harmless the Association and its officers, directors, volunteers, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Site or your violation of these Terms.

15. Suspension and Termination

We may suspend, restrict, or terminate your access to the Site or to any member account, with or without notice, if we believe you have violated these Terms, if access is being used in a manner that may harm the Association or other users, or as otherwise necessary to protect the Site and its users. Termination of Site access does not affect any obligation owed to the Association under its governing documents.

16. Changes to the Site and Terms

We may update, modify, or discontinue any part of the Site at any time without notice. We may also update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of the Site after any changes become effective constitutes your acceptance of the revised Terms.

17. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Association regarding your use of the Site, and supersede any prior understandings or agreements regarding that subject matter. These Terms do not replace the Association's governing documents, which control association membership and obligations.

19. Governing Law

These Terms and your use of the Site are governed by the laws of the State of Utah, without regard to its conflict-of-law principles.

20. Privacy

Your use of the Site is also subject to our Privacy Policy, which explains how we collect, use, and protect information about you. By using the Site, you acknowledge that you have read and understood the Privacy Policy.
